1. ACCEPTANCE OF TERMS

By accessing and using THE DIGITAL CELLAR website and services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. AGE RESTRICTION

You must be at least 18 years old to use this website and purchase alcoholic beverages. By using this website, you represent and warrant that you are at least 18 years of age. THE DIGITAL CELLAR reserves the right to verify your age at any time and to refuse service, cancel orders, or terminate accounts if age requirements are not met.

Our delivery personnel will request identification upon delivery to verify that the recipient is 18 years or older. Failure to provide valid identification will result in the order being cancelled without refund.

3. RESPONSIBLE DRINKING

THE DIGITAL CELLAR promotes responsible consumption of alcoholic beverages. We encourage our customers to:

• Drink responsibly and in moderation
• Never drink and drive
• Not provide alcohol to minors
• Be aware of the health risks associated with alcohol consumption

4. PRODUCT INFORMATION

We strive to provide accurate product descriptions, images, and pricing. However, we do not warrant that product descriptions or other content is accurate, complete, reliable, current, or error-free. If a product offered by THE DIGITAL CELLAR is not as described, your sole remedy is to return it in unused condition.

5. PRICING AND PAYMENT

• All prices are listed in Kenyan Shillings (KSH) and include applicable taxes unless otherwise stated
• Prices are subject to change without notice
• We accept M-Pesa and Cash on Delivery as payment methods
• Payment must be completed before or upon delivery
• In case of failed M-Pesa transactions, orders will be cancelled

6. ORDER ACCEPTANCE AND CANCELLATION

Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order. We reserve the right to accept or decline your order for any reason at any time after receipt of your order.

You may cancel your order before it has been dispatched for delivery by contacting our customer service. Once dispatched, orders cannot be cancelled.

7. DELIVERY TERMS

• Delivery is available only within specified areas in Nairobi, Kenya
• Delivery charges vary by location and are displayed during checkout
• Estimated delivery times are provided but not guaranteed
• Someone 18 years or older must be present to receive the delivery
• Valid ID must be presented upon delivery
• We reserve the right to refuse delivery if the recipient appears intoxicated

8. RETURNS AND REFUNDS

Due to the nature of alcoholic beverages, we cannot accept returns of opened products. We will accept returns only for:

• Damaged products (must be reported within 24 hours of delivery with photographic evidence)
• Incorrect products delivered
• Products that do not match the description

Refunds will be processed through the original payment method within 7-10 business days after approval.

9. PRIVACY POLICY

Your use of our website is also governed by our Privacy Policy. We collect and use your personal information only as necessary to provide our services and as described in our Privacy Policy. We do not sell or share your personal information with third parties except as necessary to complete transactions.

10. USER ACCOUNTS

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

11. PROHIBITED USES

You may not use our website:

• If you are under 18 years of age
• To purchase products for resale without authorization
• To purchase products on behalf of minors
• For any unlawful purpose or to solicit others to perform unlawful acts
• To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances

13. LIMITATION OF LIABILITY

THE DIGITAL CELLAR shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the website or services. Our total liability shall not exceed the amount paid by you for the specific product or service in question.

14. INDEMNIFICATION

You agree to indemnify and hold THE DIGITAL CELLAR harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms and Conditions or your violation of any law or the rights of a third party.

15. GOVERNING LAW

These Terms and Conditions are governed by the laws of the Republic of Kenya. Any disputes arising from these terms shall be resolved in the courts of Kenya.

16. COMPLIANCE WITH LAWS

THE DIGITAL CELLAR operates in compliance with all applicable Kenyan laws regarding the sale and distribution of alcoholic beverages, including but not limited to the Alcoholic Drinks Control Act.

17. MODIFICATIONS TO TERMS

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to the website. Your continued use of the website following the posting of revised terms means that you accept and agree to the changes.
